Tractor Rental Terms & Conditions
1. Agreement
This Equipment Rental Agreement (“Agreement”) is entered into between Moonlight Marine Services Ltd (“Owner”) and the individual or company identified on the rental invoice (“Renter”).
By accepting possession of the equipment, the Renter agrees to all terms and conditions outlined below.
2. Equipment
The rented equipment may include:
- Kubota L2502 tractor
- Front-end loader
- Bucket and approved attachments
- Implements listed on the rental invoice
- Safety equipment and operator manuals
The Renter confirms the equipment was inspected prior to use and accepted in good operating condition unless otherwise documented.
3. Rental Period
Rental begins on the date and time stated on the invoice and ends when the equipment is returned and inspected by the Owner.
Late returns may result in additional daily rental charges.
4. Payment Terms
- Rental charges are payable in advance unless otherwise approved in writing.
- A security deposit may be required.
- The Renter is responsible for:
- Fuel charges
- Cleaning fees
- Delivery/pickup fees
- Damage repairs
- Missing equipment or attachments
Unpaid balances may accrue interest.
5. Authorized Operators
Only competent and properly trained operators aged 21 years or older may operate the equipment.
The Renter agrees that operators will:
- Follow manufacturer operating instructions
- Use seatbelts and rollover protection systems (ROPS)
- Operate equipment safely and responsibly
- Comply with all applicable laws and workplace safety regulations in Nova Scotia
6. Prohibited Uses
The Renter shall NOT:
- Operate equipment while impaired by alcohol or drugs
- Permit unauthorized users to operate equipment
- Use equipment for illegal activities
- Overload the tractor beyond manufacturer specifications
- Operate on unsafe slopes or hazardous terrain
- Modify or disable safety equipment
- Sub-rent or transfer the equipment without written permission
7. Fuel & Maintenance
The equipment must be returned with the same fuel level as provided.
The Renter agrees to:
- Use only approved diesel fuel and fluids
- Monitor fluid levels during extended rentals
- Immediately stop use if mechanical issues arise
- Notify Moonlight Marine Services Ltd immediately of any breakdown or damage
Unauthorized repairs are prohibited unless approved in writing.
8. Damage & Loss
The Renter assumes full responsibility for loss of or damage to the equipment during the rental period, including but not limited to:
- Rollovers
- Tire damage
- Hydraulic damage
- Bent loader arms or bucket damage
- Broken lights, controls, or panels
- Theft, vandalism, or fire
The Renter authorizes the Owner to charge repair or replacement costs to the payment method on file.
9. Insurance & Liability
The Renter is responsible for maintaining adequate liability insurance for operation of the rented equipment.
Moonlight Marine Services Ltd shall not be liable for:
- Personal injury
- Property damage
- Delays
- Loss of income
- Consequential or indirect damages arising from use of the equipment
The Renter agrees to indemnify and hold harmless Moonlight Marine Services Ltd from all claims, damages, losses, and legal actions arising from use, operation, transportation, or possession of the equipment.
10. Delivery & Pickup
Where delivery is provided:
- The Renter must provide safe and accessible delivery conditions.
- Risk transfers to the Renter upon delivery.
- Additional charges may apply for failed delivery attempts or inaccessible sites.
11. Return Condition
Equipment must be returned:
- Clean and free of excessive debris
- With all attachments and accessories
- In substantially the same condition as rented, ordinary wear excepted
Cleaning or excessive wear charges may apply.
12. Default
Failure to return equipment when due may result in:
- Additional rental charges
- Recovery or repossession of the equipment
- Legal action and collection costs
Moonlight Marine Services Ltd reserves all legal remedies available under the laws of Nova Scotia.
13. Governing Law
This Agreement shall be governed by and interpreted under the laws of the Province of Nova Scotia and the laws of Canada applicable therein.
